These Terms of Service ("Terms") govern your use of the website goldenskysolutions.online and any marketing services provided by GoldenSky Solutions LLC ("GoldenSky", "we", "us", or "our"). By using this site or engaging our services, you agree to these Terms.

Services and proposals

We provide marketing consulting and related services, including campaign management, social media management, content creation, and market analysis. The specific scope, deliverables, and price of any engagement are set out in a written proposal or statement of work that we agree with you. Where a proposal conflicts with these Terms, the proposal controls for that engagement.

Pricing and quotes

Prices shown on this website are starting points to help you plan, and they may change. Your actual price is the one confirmed in your proposal. Custom engagements are quoted individually. Advertising spend paid to platforms such as Meta or Google is separate from our management fees and is your responsibility unless your proposal states otherwise.

Payment terms

• Monthly retainers are billed in advance for the coming month.
• One-time projects are billed as set out in the proposal, which may include a deposit and milestone payments.
• Invoices are due on the terms stated on the invoice. Late payments may pause work and may incur reasonable late fees where permitted by law.

Your responsibilities

To do our best work, we rely on you to provide timely approvals, access to the accounts and assets we need, accurate information, and a single point of contact for decisions. Delays in these can affect timelines and results.

Term and cancellation

Retainers begin with an initial planning period and then continue month to month. Either party may cancel future months with at least 30 days written notice. Fees already invoiced for the current period remain payable, and you keep the deliverables produced for periods you have paid for. Cancellation of a one-time project is handled under our Refunds Policy.

Intellectual property

Once an engagement is paid in full, the final deliverables we create specifically for you are yours to use. Our underlying methods, templates, know-how, and any tools we bring to the work remain our property. We may describe the work at a high level in our portfolio unless you ask us in writing not to.

Third-party platforms

Our services often run on third-party platforms with their own terms and policies. We are not responsible for those platforms, their availability, or changes they make to their rules, pricing, or algorithms.

No guarantee of results

Marketing involves factors outside our control, including markets, competitors, and platform behavior. We commit to professional effort and sound method, but we do not guarantee specific rankings, traffic, leads, sales, or revenue. Any examples or projections are illustrative, not promises.

Confidentiality

Each party will protect the other's confidential information and use it only to perform the engagement. This does not apply to information that is public, already known, or independently developed.

Limitation of liability

To the fullest extent permitted by law, GoldenSky is not liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to an engagement is limited to the fees you paid us for that engagement in the three months before the claim arose.

Indemnification

You agree to indemnify GoldenSky against claims arising from content or materials you provide, your products or services, or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New Mexico.

Changes to these Terms

We may update these Terms from time to time. Continued use of the site or our services after an update means you accept the revised Terms.
